BecomingX Foundation retains the exclusive right to settle, compromise and pay, without your prior consent, any and all claims or causes of action which are brought against us. We reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us and you agree to cooperate with our defence of these claims. We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

We may terminate these Terms and your permission to use the website immediately if you commit any breach of these Terms, we are prevented from providing the website for any reason or for any other reason as we see fit.

Force Majeure

These Terms and your use of the website are governed by the laws of England. Any disputes arising from or relating to the website, any transactions made on or through the website and/or these Terms will be subject to the exclusive jurisdiction of the English courts.

General

If any provisions of these Terms are held to be void, invalid or unenforceable, this will not affect the validity or enforceability of the remaining provisions.

These Terms constitute the entire agreement between you and BecomingX Foundation relating to the subject matter of these Terms and supersede all other communications and proposals, whether electronic or written, between you and BecomingX Foundation relating to the subject matter of these Terms. Other services provided via our website, including, but not limited to, donating to BecomingX Foundation are governed by separate terms.

We may assign any or all of our rights and obligations under these Terms to any third party. The Terms and any rights and licences granted hereunder, may not be transferred or assigned by you.

No failure or delay by us in exercising any right under the Terms shall operate as a waiver of such right nor shall any single or partial exercise by either party of any right preclude any further exercise of that right or the exercise of any other right.

BecomingX Foundation is the controller (also known as a data controller) and this means we are responsible for, and control the processing of,  your personal information. .

  • When you contact us through partners or third parties working on our behalf: This could be if you contact us through one of the other third parties that we work with (for example Just Giving) and provide your consent for your personal information to be shared with us.

The information we receive will depend on the privacy preferences you have set on each platform and the privacy notices/policies of each platform. Personal information you disclose to us

In short: We collect personal information that you provide to us including information such as name, address, and contact information

We collect personal information that you voluntarily provide to us when donating to us, registering as fundraisers or volunteers  or otherwise contacting us. The personal information that we collect depends on the context of your interactions with us. When you donate, fundraise and/or when you otherwise deal with us, we may collect the following information about you (Information):

  • Identity Data: This includes first name, last name, date of birth and gender.
  • Contact Data: This means the data we use to contact you including your billing address, contact address, email address and contact phone number.
  • Financial Data: This means the payment method and card association used to process your online payments for any donations, fundraising or other services relating to the Foundation We do not store or process your card details ourselves, we use a contracted third-party supplier to manage online payments.
  • Usage Data: This includes information about how you use the BecomingX Foundation website. This includes your browsing patterns and information such as how long you might spend on one of our webpages, what you look at and for, the page that referred you to the BecomingX Foundation website and the click stream during your visit to our website, page response times and page interaction information (clicks you make on a page).
  • Marketing and Communications Data: This includes your preferences for receiving marketing from us and your communication preferences.
  • Other information: This includes any other information that you choose to provide us, which might include data in research surveys or information relevant to job applications or volunteering opportunities, including data on your education, work experience and career.

  • Responding to a request: to provide the services or information that you have requested, for example in response to a query or complaint.
  • Administration: to update you with important administrative messages about your donation, a campaign or services, or to record and deal with a complaint, record a request not to receive further marketing information, record what our volunteers have done for us, and for other essential internal record keeping purposes.
  • Monitoring and evaluating our services: we may use your information in order to improve current and future delivery of our services.
  • Processing an application to work with us: we may process your information if you send or fill in an application form or send us your CV or details in respect of an opportunity to work with us in order to evaluate your suitability and respond to you or, where you volunteer with us, to administer the volunteering arrangement.
  • Employment: we need to ensure that we meet our obligations as an employer and manage people effectively in the organisation.
  • Working with children and young people: we collect essential information to enable us to safeguard any young people we work with, for example, in campaigns or events.
  • Fundraising, direct marketing or campaigning: we will only send you marketing information by email, SMS, or telephone you if you have given us specific consent. If you withdraw your consent and then subsequently opt in to receive marketing information again, then your most recent preference will supersede your earlier one. To do this we sometimes use profiling and screening methods so that we can better understand our supporters and potential supporters, your preferences and needs to provide a better experience for you.
  • Legal, regulatory and tax compliance: Where we are subject to a legal obligation, we may process your personal information to fulfil that obligation.
  • Market research and surveys: We may invite you to participate in surveys or market research to help us improve our website, fundraising, services, and strategic development. Participation is always voluntary, and no individuals will be publicly identified as a result of this research, unless you consent to us publishing your feedback.
  • Protecting your vital interests: We may process your personal information where we reasonably think that there is a risk of serious harm or abuse to you or someone else.

 

Will your Information be shared with anyone?

In short: We will only use your information to comply with Contractual obligations, fulfil our Business Purposes, or with your Consent.

We only share and disclose your Information in the following situations:

  • Contractual: to enable any orders or requests for fundraising products or services in connection with the BecomingX Foundation to be fulfilled.
  • Vital Interests: We may disclose your Information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
  • Third-Party Service Providers: We may share your Information with third-party vendors, service providers, contractors or agents who perform services and require access to such information to do that work. Examples include data analysis, email delivery, hosting services, fundraising activities and campaigns. They will only have access to your Information to the extent that they need to perform those services. They are required to keep your Information confidential and may not use it other than as we ask them to and always in accordance with this Policy.
  • Business Partners: Only if you have given us Consent to do so, we may share your Information with our charity or business partners to offer you certain products, services, or promotions.
  • Legal Obligations: We may disclose your Information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
  • With your Consent: We may disclose your Information for any other purpose with your Consent.

We may disclose aggregated, anonymous information (i.e. information from which you cannot be personally identified), or insights based on such anonymous information, to selected third parties, including (without limitation) analytics and search engine providers to assist us in the improvement and optimisation of the BecomingX Platform. In such circumstances we do not disclose any information which can identify you personally.

Is your Information transferred internationally?

In short: We may transfer, store, and process your Information in countries other than your own but will take all reasonable steps to ensure it is p­­­­­rotected.

We may transfer your information outside of the UK for certain purposes. Whenever we transfer your Information outside of the UK, we will take all reasonable measures that we can to protect your Information in accordance with this Policy and applicable law. If the Information will be transferred outside of the European Economic Area, we will ensure than any additional required measures and/or safeguards are in place, such as entering into the European Commission approved standard contractual clauses and specific International Data Transfer Agreements.

Your Consent to processing

You will be required to give Consent to certain processing activities before we can process your Information. If you have previously given your Consent, you may freely withdraw such Consent at any time. You can do this by emailing info@becomingxfoundation.org .

If you withdraw your Consent, and if we do not have another legal basis for processing your Information, then we will stop processing your Information. If we do have another legal basis for processing your Information, then we may continue to do so, subject to your legal rights.

How long do we keep your Information?

In short: We keep your Information for as long as necessary to fulfil the purposes outlined in this Policy, unless otherwise required by law.

We will only keep your Information for as long as it is necessary for the purposes set out in this Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing Business Purpose to process your Information, we will either delete or anonymise it, or, if this is not possible (for example, because your Information has been stored in backup archives), then we will securely store your Information and isolate it from any further processing until deletion is possible.

How do we keep your Information safe?

In short: We aim to protect your Information through a system of organisational and technical security measures.

We have implemented appropriate technical and organisational security measures designed to protect the security of any Information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your Information, transmission of your Information to and from the BecomingX Foundation website is at your own risk. WHAT ARE YOUR PRIVACY RIGHTS?

In short: You have certain rights in respect of your Information.

Please note we will require evidence of your identity before we are able to respond to your request.   • Right to Object to or Restrict Processing: In certain circumstances, you have the right to object to our processing of your Information. While we are happy for such requests to be made, we are not able to guarantee technical compatibility with a third-party organisation’s systems. We are also unable to comply with requests that relate to personal information of others without their consent.

Please note that we have the right to reject deletion requests that are unduly burdensome or repetitive or that cannot be honoured in light of legal obligations or ongoing disputes, or where retention is necessary to enforce our agreements or protect our or another party's rights, property, safety, or security. For example, we may retain information to prevent, investigate, or identify possible wrongdoing and to comply with legal obligations.
